Terms and Conditions for On-Time Closing Guarantee Pilot Promise
Guarantee Offer: Aviator Home Loans (“the Company”) offers a guarantee of an on-time closing on your mortgage loan. If we fail to close your loan on or before the scheduled closing date, we will pay you $500.
Eligibility: This guarantee is available to clients who have a mortgage loan application with Aviator Home Loans and have received a formal guaranteed Loan Approval from the Company.
Scheduled Closing Date: The scheduled closing date is the date agreed upon by Aviator Home Loans and the client, as documented in the loan application process.
Client Responsibilities: To be eligible for this guarantee: All requested documentation must be provided promptly by the client. The client must adhere to all timelines and requests made by Aviator Home Loans during the loan processing. There must be no changes to the client’s financial situation that could affect the loan approval.
Exceptions: This guarantee does not apply if delays are caused by events outside Aviator Home Loans’ control, including but not limited to: Natural disasters or other major events leading to general business disruptions. Delays due to third parties, such as appraisers, not associated with Aviator Home Loans. Any changes in federal, state, or local laws or regulations that affect the loan process. Delays caused by the client, including incomplete or inaccurate documentation.
Claim Process: To claim the $500 payment: Clients must notify Aviator Home Loans within 5 business days of the missed closing date. Clients must provide proof of the agreed closing date and demonstrate compliance with all relevant terms and conditions.
Payment Process: Upon validation of a claim, the $500 payment will be made to the client within 30 days.
Limitation of Liability: The maximum liability of Aviator Home Loans under this guarantee is limited to a payment of $500. Aviator Home Loans is not responsible for any indirect, special, incidental, or consequential damages.
Modification and Termination: Aviator Home Loans reserves the right to modify or terminate this guarantee at any time, without prior notice.
Governing Law: These terms and conditions are governed by the laws of the state of Georgia.
